Constitutional Crash Test Dummies

So, President Barack Obama has evolved, devolved, re-evolved and now favors same-sex marriage and the MSM has a collective orgasm. But, frankly, the political slight of hand at work here reminds me of the classic head-on collision between reason and power in the movie Jaws:

Contrary to popular opinion this “hot bed” political issue is not about gender or sexual preferences or even “civil” rights for an “oppressed” minority. The tug of war here is the classic battle between government and religion, with the homosexual community in the role of the oft abused crash test dummy from Mythbusters in this societal stress test of our Constitution’s First Amendment — You know, the one that begins:

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof . . .

Government issues marriage licenses for its Citizens to establish a legal kinship relationship. Religions conduct services and ceremonies to bless, celebrate and sanctify the familial union of their members according to their commonly held beliefs.

If a government wants to license same sex marriages (like New York, Massachusetts, Connecticut, Iowa, Vermont, and New Hampshire) or a particular religion believes in the sanctity of same-sex marriage (like the Episcopal Church, the Evangelical Lutheran Church in America or the United Church of Christ) fine — No problem — go forth and multiply. Sorry.  But seriously, this is America.  Move to one of those states.  Join one of those religions.  Go live your life and pursue happiness.

But if government establishes marriage as a “Civil Right,” then what happens if a particular church does not believe in nor sanctify same-sex marriage and that institution refuses to perform or bless such unions? Are those religious beliefs trumped by the secular dictates of Government? Will those churches be legally and financially persecuted for their beliefs in the name of equality and justice?

Anyone remember, oh so long ago, how the federal government woke up one day and just declared that a woman’s right to contraceptives trumps the beliefs and teachings of the Catholic Church?

President Obama has tried to change the sense of the First Amendment by recognizing “freedom of worship”, which is very, very different from the “free exercise” of religious beliefs.  In other words, you can have your church service on Sundays, but on Saturdays or any other day you had better not think about actually practicing those beliefs by declining to provide employees with contraceptives or by refusing to allow homosexual couples to get married in your church.

Make no mistake this fight is not about protecting the legal rights of a minority.   It is the next battle in the Secular Reformation.  The fact that civil unions or domestic partnerships are not acceptable solutions betrays a purposeful political and cultural strategy to impose secular humanism on our society and annul the First Amendment.  The last annulment this big, ended up with Anne Boleyn losing her head.

Unlike taking prayer out of government schools . . . . or removing Christmas decorations in the town square . . . . or taking down the Ten Commandments from the courthouse wall . . . . forcing same-sex marriages on religious institutions will see the federal government literally invading the sanctuaries of religions.

This puts gay men and lesbians in the driver’s seat of a veritable Constitutional Mythbusters test.

And we all  know what happens to Buster.

“[Eric] Schmidt was a campaign advisor and major donor to Barack Obama, and when he announced he was leaving that perch, he planned to remain ‘at the forefront of Google’s government relations team.’ And Obama even has considered him for Commerce Secretary.  Schmidt was an informal advisor to the Obama presidential campaign and began campaigning the week of October 19, 2008, on behalf of the candidate.   He had been mentioned as a possible candidate for the chief technology officer position which Obama created in his administration.   After Obama won, Schmidt was a member of President Obama’s transition advisory board. Sasha & Malia Should Help Their Dad with his Homework

No, Mr. Obama, raising the debt ceiling without dealing with the government’s out of control spending  is the equivalent of saying, “Give me a new Visa card otherwise I won’t be able to make the payments on my other Visa cards — oh yeah and hurry up because I don’t want to miss going to Disney World this summer.”

Every family — Most families know instinctively this is not being “responsible” and many have to pick and choose between steak and baloney all the time.

I hope when Sasha and Malia are doing their homework they are learning the real life lessons their father evidently has not.

Cutting a Conservative Gordian Knot

Conservatives and some Republicans generally believe that free markets and the private sector do things far better, faster and more efficiently than government – USPS & FedEx vs USPS, Private Schools vs Government Education, Ford vs GM, Physicians vs ObamaCare, Parents vs the Department of Health and Human Services – except when it comes to the military, which is hailed as being the finest in the world, even if the Pentagon might not be the most cost-effective government money meat grinder.

The bottom line is that, absent interference from political arm-chair generals, the U.S. Armed Forces, from Washington to Grant to Patton to Schwarzkopf & Franks, have a pretty solid track record of getting the job done.

Well, if the government can get something so hugely complex as the military right, a liberal might say, why can’t it work for the economy or health care or nutrition or education? Typical right-wing, anti-government hypocrisy, no doubt.

A Gordian Knot, perhaps, but maybe one that can be sliced.

Karl von Clausewitz, Leonard Wood and Marine Drill Instructors all seem to agree that the primary purpose of a military is to “kill people and break things.”

One has to wonder if those are really the skill sets which should be brought to bear on the economy, the practice of medicine, education or family values.

The Army, Air Force, Navy, and Marines are only the government’s most powerful forces to coerce compliance with its wishes and will. Make no mistake, though, government for good or for ill is all about the application of force – restricting, constricting, often destructive force.

The force of government is good when it is directed at protecting our nation and the freedoms enshrined in the Declaration of Independence and the U.S. Constitution.

That force is bad when it is used to coerce citizens to live only that life, to enjoy only those liberties and to pursue only those happinesses that the government sees fit for them to live, to enjoy and to pursue – and be damn happy about it or else!

There is a very good reason the founders took great pains to erect a limited government for this nation and to establish a so-called “negative” Bill of Rights for citizens, and not “positive” rights for the government (sorry President Obama).

It can never hypocritical to be careful, prudent and discriminating in how, when and where government power is applied, especially when it is directed inward at citizens.

Besides, in practical terms, it rarely works out well: I’d much rather drive a Ford than a Trabant.

A Modest Tax Proposal

What to do . . . what to do . . . what to do with all those evil rich people, once the government gets done taking all of their money away.

Well, they are already fat (as in “fat cats”) and no doubt their lazy veal-like existence makes them quite tender, so I say let’s herd them up, lead them to the slaughter and feed them to public school children:


The only question is whether such a “rich” diet would satisfy Michelle Obama’s nutrition requirements for fat children, but her man Barack can get the FDA working to crack that national security risk.

Let’s not soak the rich . . . let’s marinate them.
